The Articles of Impeachment Against President Trump Won’t Fly

Yesterday, the House Judiciary Committee approved two articles of impeachment (abuse of power and obstruction of Congress) against President Trump on 23-17 party line votes.

Abuse of Power

The abuse of power article of impeachment against President Trump is problematic for several reasons:

  1. President Trump released funds to Ukraine that had been withheld previously by President Obama, and he approved the sale of Javelin missiles to Ukraine. That’s something Obama refused to do.
  2. House Democrats didn’t object to Obama’s refusal to transfer funds to Ukraine or his decision to deny the sale of Javelin missiles to Ukraine, but they reacted violently when President Trump insisted that Ukrainian President Zelensky follow through on a campaign promise to root out corruption in Ukraine.
  3. House Democrats claimed that President Trump was trying to use the funds that had been allocated by Congress as leverage to force Ukrainian President Zelensky to assist him in his campaign for re-election by digging up dirt on Joe Biden. Both President Trump and President Zelensky denied that allegation.
  4. During the impeachment hearings in the House Intelligence Committee, the fact witnesses that were handpicked by Chairman Adam Schiff stated clearly that President Trump did not demand a quid pro quo. They said that President Trump simply told President Zelensky “to do the right thing.”
  5. Joe and Hunter Biden were up to their eyeballs in Ukraine corruption, and Joe is a candidate for the Democrat nomination for president. That’s the only justification for the abuse of power article of impeachment, and it falls flat because no one is above the law.
  6. Candidates for president can’t commit crimes with impunity, and presidents have a duty to enforce the law.  Investigating criminal activity is not an impeachable offense.
  7. Republicans on the House Intelligence Committee wanted Joe and Hunter Biden among others to be called as witnesses during the impeachment hearings, but Chairman Adam Schiff rejected their request. In effect, Schiff denied the president a fair hearing by denying virtually every request made by Republicans on the committee.  As a result, during the impeachment hearings in the House Intelligence Committee, only the Democrat case was presented, and President Trump was denied due process.

Bottom Line: Democrats can’t claim abuse of power if they refuse to allow witnesses to testify if they can refute Democrat arguments.  An impeachment hearing is not a platform for presenting only the Democrat narrative.

Investigating criminal activity is not an impeachable offense.

Obstruction of Congress

The second article of impeachment against President Trump is ridiculous.  Invoking executive privilege is not an abuse of Congress.  Any president has a constitutional right to invoke executive privilege to protect the Office of the President and to prevent privileged and sensitive information about ongoing operations from being revealed prematurely or inappropriately.

If leaders in Congress believe the president is abusing executive privilege, they can take him to court.  It takes a while to adjudicate the dispute, because eventually the case has to be decided by the Supreme Court.

Democrats in the House didn’t want to challenge the president’s executive privilege claims because of the time involved.  They were in a hurry to impeach him no matter what.  That mistake will cost them dearly in the 2020 presidential election and in congressional elections.

Bottom Line: Congress can’t claim that the president obstructed Congress by exercising his constitutional rights.

The Impeachment Trial in the Senate

House Democrats have been screaming “Impeach!” since the day President Trump was elected in 2016.  In the 2018 midterm elections, Democrat candidates for the House promised to impeach the president.  When Nancy Pelosi became Speaker of the House in 2018, Jerry Nadler campaigned for Chair of the House Judiciary Committee by promising to impeach President Trump and Justice Kavanaugh.

“Impeach!” isn’t just the Democrats’ mantra.  It has been their manic obsession for 3 long years.  People like Adam Schiff and Nancy Pelosi look and sound like lunatics as they make their case for impeachment, because they have nothing to hang their hats on despite 2 investigations that have cost American taxpayers well over $50 million.

In a few days, the full House will vote to impeach the president.  I doubt that any Republicans will vote in favor of impeachment, but some Democrats will vote against impeachment.  The articles of impeachment will be sent to the Senate for a trial.

In the Senate, President Trump will be acquitted.  If House Democrats had been serious about impeachment, they would have taken the time to do the job properly.  Democrats didn’t do it right, because they know the facts don’t support their case and the facts never will support their case.

In other words, the impeachment circus is a political stunt to reduce the probability of President Trump winning re-election.  Democrats are failing miserably.  The American people are waking up to reality.  President Trump is growing stronger by the day, and Democrats are being revealed as the charlatans they are.

If Democrats keep it up, they will begin to lose support from their base.  I think that’s beginning to happen now.

Switching Gears

FBI, DOJ, CIA, and other government agency involvement in trying to unseat President Trump is just beginning to get the attention it deserves.  When the facts are revealed, people will understand why Democrats in the House are so anxious to impeach President Trump.
