A federal judge on Friday night blocked President Donald Trump from tapping into Defense Department funds to build parts of his US-Mexico border wall.

In a 56-page ruling, Judge Haywood Gilliam of the Northern District of California blocked the administration from moving forward with specific projects in Texas and Arizona, saying Trump couldn’t disburse the funds without congressional approval. The lawsuit that prompted the ruling was filed by the American Civil Liberties Union on behalf of the plaintiffs, the Sierra Club and Southern Border Communities Coalition.

Although Friday’s ruling does not prevent the Trump administration from using funds from other sources to build the projects, it’s a setback for the President on a signature agenda item that has consistently been thwarted by Democrats in Congress. Construction on the projects affected by the ruling could have begun as early as Saturday, according to the ruling.

Judge Gilliam is an Obama appointee. Virtually every federal judge who has attempted to block President Trump on a variety of initiatives is an Obama appointee.

“These days, clashes between Congress and the executive steal the headlines, as I [Attorney General Barr] know very well. But clashes between the judiciary and the political branches are also very weighty,” Barr said at a speech to the American Law Institute in Washington, DC. “These nationwide injunctions have frustrated presidential policy for most of the President’s term with no clear end in sight.”

In his speech, Barr took aim at recent decisions by two federal appeals courts that blocked the Trump administration from rescinding the Obama-era Deferred Action for Childhood Arrivals program, which protects young undocumented immigrants who came to the United States as children from being deported, citing them as ways he sees courts disrupting the executive branch’s ability to create and carry out policy.

In one case, the Ninth Circuit Court of Appeals upheld in November a nationwide injunction allowing DACA to remain in effect. The Department of Justice has a pending request with the Supreme Court to take up an appeal, but the justices have so far declined to do so, which Barr criticized in his speech Tuesday evening.

“But the court has not granted any of those requests, and they languish on the conference docket. Unless the court acts quickly and decisively, we are unlikely to see a decision before mid-2020 at the earliest — that is, right before the next election. It is hard to imagine a clearer example of the stakes of nationwide injunctions.”

He added: “While DACA case provides a stark example of the trend in nationwide injunctions at this point, it is hardly an outlier. Since President Trump took office, federal district courts have issued 37 nationwide injunctions against the executive branch. That’s more than one a month.”

The attorney general also said the increasingly frequent nationwide injunctions “undermine public confidence in the judiciary.”

“When a single judge can freeze policies nationwide, it is not hard to predict what plaintiffs will do. In Professor (Samuel) Bray’s memorable phrase, they ‘shop ’til the statute drops.'”

The Justice Department, under former Attorney General Jeff Sessions, argued that the Obama administration acted unlawfully when it implemented DACA. Texas and other Republican-led states eventually sued and won a partial victory in a federal court in Texas.

Civil rights groups, advocates for immigrants and Democratic-led states all have sued to prevent the end of the program. A three-judge panel of the federal appeals court in San Francisco ruled that the administration decision to end DACA was arbitrary and capricious.

Barr said Trump “lost much of his leverage” in negotiations with congressional Democrats, who were pushing for a permanent solution for DACA recipients, after one district court judge issued an order forcing the administration to maintain the program nationwide.

“Unsurprisingly, those negotiations did not lead to a deal,” Barr said.

In his speech to the American Law Institute, Barr argued it isn’t about partisanship and said the approach taken by judges who issue these nationwide rulings departs not only from the limitations of the Constitution, but also from the “traditional understanding of the role of courts.” The Justice Department will continue to oppose such rulings, he said.

“Nationwide injunctions not only allow district courts to wield unprecedented power, they also allow district courts to wield it asymmetrically,” Barr said.

Other judges have issued similar injunctions against Trump’s “travel ban,” against his effort to delay a sweeping “clean water rule” issued by the Obama administration, and against an order of his intended to protect religious freedom. (The Supreme Court reversed the injunction against the travel ban.) In all, Barr said, district judges have issued at least 37 nationwide injunctions against the Trump administration in barely more than two years. They issued such injunctions only 27 times in the entire 20th century, he said.

The Trump administration has been hounded by such injunctions more than any other, but the threat applies across ideological lines. A trial judge in Texas, for example, blocked an ill-advised Obama administration directive that public schools allow students to use bathrooms corresponding with their chosen “gender identity,” not their biological sex.

A Scary Possibility

Federal judges, most of them Obama appointees, have taken it upon themselves to govern our nation in Obama’s absence.  They have assumed the roles of the executive and legislative branches of government.  Since they have control of the judicial branch as well, that gives them virtually complete control of our government

None of the federal judges were elected.  They have lifetime appointments, and they will never have to answer to voters for the decisions they have made.

According to AG Barr, federal judges have issued at least 37 nationwide injunctions since President Trump took office. That’s more than one a month.  AG Barr also said that only 27 nationwide injunctions were issued in the 20th century.  Obviously, something changed dramatically when Donald Trump won the 2016 presidential election.

Could it be that the federal judges appointed by Obama are taking orders from the former president and doing his bidding even though he is no longer in office?  Don’t rule out that possibility.

Following the 2016 election, establishment media titans publicly announced that they were hiring virtual hit squads to take down the Trump presidency.  That’s not journalism.  It’s organized crime.

The establishment media seems to be acting in unison.  They even use the same words in their narratives.  Are they coordinating with someone?  If so, who?

AG Barr’s investigation of the Russia collusion hoax may lead to findings that will shock our nation.  Did people in the Obama White House use the DOJ, the FBI, the IRS, our intelligence agencies, and other agencies of government in an attempt to prevent Donald Trump from winning the 2016 election?  If yes, was Obama involved?  Did he give the orders?

Are some of those same people using the federal courts to pursue their objectives while Democrats are out of power?

We may be witnessing an attempt to destroy our constitutional form of government and install a virtual dictatorship.  That may sound like bad fiction, but it could be exactly what’s taking place.

This may be a much bigger deal than people think.  We may be in the early stages of a real revolution.
