Democrats Making Moral Arguments Leave Me Cold

The reason for Republicans to hold off isn’t the extraordinary hypocrisy they’re showing by pushing a rapid confirmation now, despite holding Justice Antonin Scalia’s seat open in 2016. Unfortunately, we don’t live in a world where voters will punish a party for arrant hypocrisy. Republicans and Democrats alike all understood that McConnell was making a specious argument when he claimed the March nomination of Judge Merrick Garland was too close to the November election to deserve a vote. We all knew it was power politics then; and we all know it is power politics now.

To be clear, Trump has the constitutional authority to nominate a new justice right now and the Senate has the authority to vote — or not vote — on that nominee. The arguments pro and con are moral and political, as I’ve noted before, not legal.

Noah Feldman

Noah Feldman wrote the article above. Below are a few other articles that Feldman has written for Bloomberg over the past few weeks. It seems as though Feldman has made a living criticizing President Trump and anyone who has done anything that might be viewed as helpful to the president and the implementation of his policies.

Feldman is the Felix Frankfurter Professor of Law at Harvard Law School. Most of us remember him as one of the “fact witnesses” who testified during the House Judiciary Committee’s hearing in December 2019 after which it passed two articles of impeachment against President Trump, neither one of which involved the commission of a crime much less a high crime or misdemeanor.

The other “fact witnesses” were Pam Karlan from Stanford Law School, Michael Gerhardt from The University of North Carolina Law School, and Jonathan Turley from The George Washington University Law School:

In case you don’t recall, Pam Karlan didn’t wear her pink pussy hat to the Judiciary Committee hearing. I guess she thought it wouldn’t be dignified, and she probably didn’t want the hearing to look like a circus sideshow. She failed on that count.

Moral Arguments?

In yesterday’s Bloomberg article, Feldman graciously admits that President Trump has the authority to nominate someone to fill Ruth Bader Ginsberg’s seat on the Supreme Court. He even acknowledges that the Senate has the authority to confirm the president’s nominee before the election. Then he mentions moral and political arguments against moving down that path.

I don’t want to delve into the arguments themselves. They aren’t particularly meaty. I want to focus on Feldman’s reference to a “moral argument”.

Feldman is a Democrat operative in academia. His political party staunchly supports abortion on demand at any stage of fetal development, gay marriage, sodomy, and pedophilia to name just a few. Feldman’s party is leaning toward supporting infanticide, too, but he can’t see the moral arguments against those abominations.

Democrats alluding to morality remind me of Nazis talking about human decency.
